These Terms of Service ("Terms") form a legally binding agreement between you and us governing your access to and use of our comprehensive online testing platform, including the website, mobile applications, and related services (collectively, the "Services"). Please read these Terms carefully before using the Services. By creating an account, subscribing, or otherwise accessing the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, our Refund Policy, and any other policies referenced herein.

1. Eligibility

You must be at least the age of digital consent in your jurisdiction (typically 16 in the EU/UK, 13 in the US, or such other age as required by applicable local law) to use the Services. If you are under the age of majority in your jurisdiction, you may only use the Services under the supervision of a parent or legal guardian who has read and agreed to these Terms on your behalf. We do not knowingly provide the Services to any person who is barred from receiving them under applicable law.

2. Account Registration and Security

To access certain features of the Services, you may be required to register an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@psychtestlab.com of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this obligation.

4. Scope of Support

• Account Issues: login errors, password reset, account security, and account recovery.
• Content & Accessibility: video playback errors, missing or incorrect subtitles, audio/visual quality issues, content removal requests, and region restrictions.
• Billing & Subscriptions: subscription activation, cancellation, payment failures, unauthorized charges, and invoice-related inquiries.
• Technical Support: app or website malfunctions, device or OS compatibility issues, and bug reports.
• Feedback & Reports: user suggestions, copyright infringement notices, and inappropriate content reports.

6. Response Time

• Urgent Issues (e.g., payment fraud, account hacking): within 1 hour.
• General Inquiries: within 12 hours.
• Complex Requests (e.g., refund investigations): within 48 hours, with progress updates.

7. Refund and Cancellation

Subscription services are offered on a weekly, monthly, and yearly basis and may be canceled at any time. Once canceled, no further charges will be applied to the next billing cycle. As a general rule, subscription fees paid for an activated subscription are non-refundable, regardless of whether the service has been used, except as expressly set out in Section 2 of our Refund Policy (Eligible Refunds). Promotional, gifted, or redeemed content (including coupons, bonus periods, and reward-based entitlements) is non-refundable and non-transferable. Refund requests, where permitted, must be submitted within 14 days of the purchase date by contacting support@psychtestlab.com with the required details. The full terms and process are set out in our Refund Policy, which is incorporated into these Terms by reference.

8. Subscription and Billing

The subscription and auto-deduction services of this Website are operated and maintained by us. By using our subscription services, you agree to the following terms, in addition to the Refund and Cancellation provisions set out in Section 7 above and our separate Auto-Deduction Agreement.

8.1 Subscription Plans

psychtestlab.com offers subscription plans billed in daily, weekly, monthly, quarterly, or yearly cycles, depending on the plan you select. The specific subscription period, pricing, and features (such as access to the full test library, advanced assessments, detailed result reports, and an ad-free experience) will be clearly displayed on the website at the time of purchase. All prices are inclusive of applicable taxes.

8.2 Trial Period

After registering, you may have the option to try psychtestlab.com for a specified period at the amount indicated on our website ("Trial Period"). After the Trial Period ends, you will be automatically upgraded to the applicable subscription plan based on your country/region or applicable promotional/testing offers. If you do not wish to continue with the paid subscription, you must cancel before the Trial Period ends to avoid being charged.

8.3 Auto-Renewal

Your subscription will automatically renew at the end of each billing period, and the payment method you have provided will be automatically charged. If you do not wish to auto-renew, you must disable auto-renewal in the "Billing" section of your account at least 24 hours before the end of the Trial Period or current Subscription Period. If you forget to disable auto-renewal for a new subscription period, this is not a valid reason for a refund.

9. User Responsibilities

• Provide accurate account and transaction details for faster resolution.
• Avoid abusive language, harassment, or spam when interacting with our support team. Violations may result in restricted access to support or, in serious cases, suspension of your account.
• Comply with all applicable laws, regulations, and these Terms when using the Services.

10. Prohibited Use

You agree not to use the Services to: (a) access or use the Services from a sanctioned region or as a sanctioned person (see Section 13); (b) reproduce, redistribute, resell, scrape, or commercially exploit any Content; (c) use any robot, spider, scraper, or other automated means to access the Services or extract Content; (d) circumvent, reverse-engineer, or otherwise interfere with any technological measure we use to protect the Content or the Services; (e) share your account credentials or allow multiple persons to access the Services through a single account; (f) upload, post, or transmit any content that is unlawful, infringing, defamatory, obscene, harassing, or otherwise objectionable; (g) interfere with or disrupt the integrity or performance of the Services or the data contained therein; or (h) use the Services for any unlawful purpose or in violation of any applicable laws or regulations.

11. Intellectual Property

The Services, including but not limited to the brand, logos, design, text, graphics, and software (excluding the Content), are owned by us or our licensors and are protected by international copyright, trademark, and other intellectual property laws. All product names, logos, and brand identifiers mentioned on the Services are the property of their respective owners, and any references to them are made solely for identification or descriptive purposes.

12. Copyright and Content Licensing

All test content, questions, scoring algorithms, assessment reports, methodology documentation, and any other intellectual property made available on psychtestlab.com (the "Content") are owned by us or have been licensed to us by their respective rights holders under valid and lawful authorization. The Content is protected by international copyright laws, treaties, and other intellectual property laws. No part of the Content may be reproduced, distributed, transmitted, displayed, performed, modified, reverse-engineered, sold, or otherwise exploited for any commercial or non-personal purpose without our prior written consent. Your subscription (where applicable) grants you a limited, non-exclusive, non-transferable, revocable license to access and view the Content for personal, non-commercial entertainment purposes only. Unauthorized use, copying, redistribution, scraping, downloading (other than temporary caching for personal streaming), or re-uploading of the Content may result in the suspension or termination of your account and may expose you to civil and/or criminal liability. We actively monitor, detect, and enforce against copyright infringement and reserve the right to take appropriate legal action, including cooperation with rights holders and competent authorities.

If you believe any Content infringes your copyright, please contact us at support@psychtestlab.com with the title, URL, a description of the work and the alleged infringement, and your contact information. We will investigate and, where appropriate, remove or restrict access to the allegedly infringing Content in accordance with applicable law.

13. Privacy and Data Protection

All customer support interactions are confidential. Your personal data is processed in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

14. Sanctioned Regions and Restricted Use

Our Services are not available to, and may not be activated or used by, users located in, resident of, or nationals of any country or region that is subject to comprehensive international sanctions or embargoes (including but not limited to: Cuba, Iran, North Korea, Syria, the Crimea, Donetsk People's Republic, and Luhansk People's Republic regions, or any other country or region that may be added to applicable sanctions lists from time to time). You also represent and warrant that you are not on any list of sanctioned or restricted persons maintained by the United Nations, the United States (OFAC), the European Union, the United Kingdom, or any other relevant authority. You agree that you will not access or use the Services from any such country, region, or as a restricted person. We reserve the right to refuse, suspend, or terminate your access, and to decline any renewal or refund, if we reasonably believe that you are in violation of this provision.

15. Suspension and Termination

We may, at our sole discretion, suspend or terminate your account and access to the Services at any time, with or without prior notice, if: (a) you breach any provision of these Terms, including the Prohibited Use obligations and the sanctioned regions restrictions; (b) your payment cannot be processed; (c) we are required to do so by law, regulation, court order, or a competent authority; or (d) we reasonably suspect fraudulent, abusive, or illegal activity in connection with your account. Upon termination, your right to use the Services will cease immediately. Prepaid subscription fees are non-refundable upon termination for cause under this Section, except as required by applicable law.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services and the Content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected.

17. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall we, our affiliates, directors, employees, agents, partners, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Services or the Content, even if we have been advised of the possibility of such damages. In any event, our aggregate liability arising out of or relating to these Terms shall not exceed the total amount of subscription fees actually paid by you to us during the twelve (12) months immediately preceding the event giving rise to the liability. Nothing in these Terms shall limit or exclude liability that cannot be limited or excluded under applicable law.

18. Indemnification

You agree to indemnify, defend, and hold harmless us and our affiliates, directors, employees, agents, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of, or access to, the Services; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including any copyright, trademark, privacy, or other proprietary right; or (d) any claim that your conduct has caused damage to a third party.

19. Dispute Resolution, Governing Law, and Jurisdiction

19.1 Friendly Negotiation

The parties shall first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms through friendly negotiation. You may contact us at support@psychtestlab.com to initiate such negotiation.

19.2 Governing Law

This Agreement/Policy shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict-of-law principles. You agree that any dispute, claim, or controversy arising out of or relating to this Agreement/Policy shall be subject to the exclusive jurisdiction of the courts located in Singapore, unless mandatory consumer protection laws in your jurisdiction grant you the right to bring an action before your local courts.

19.3 Class-Action Waiver

To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class-action waiver is held unenforceable, the entirety of this Section 19.3 shall be void and unenforceable.

20. Changes to These Terms

We may revise these Terms from time to time. The latest version will always be posted on this page, with an updated effective date. For material changes that significantly affect your rights or obligations, we will give you reasonable advance notice via email, in-app/site notice, or other prominent means. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you may stop using the Services and cancel your subscription as described in our Refund Policy.

21. Severability and Entire Agreement

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms, and the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and us with respect to the Services and supersede all prior or contemporaneous communications on the same subject matter.
